This is a timed on-line only auction, the bidding will begin closing Monday, October 30th, 2023 at 6 pm.

Bidding Information:
You must be a minimum of 18 years of age in order to bid, except for the firearms and ammunition lots you must be a minimum of 21 years of age in order to bid.
When you place a max bid, the current bid price does not automatically go to your max bid. The computer will automatically bid up to your max bid in the increments specified as other bidders place bids or in the event of a lot with a reserve, it can bid against the reserve.
This auction uses the auto extend feature, meaning the auction will not close until all bidding parties are satisfied. If any bids are placed within the last 2 minutes of the item closing, the bid on lot(s) will extend for an additional 2 minutes. The bidding will extend in 2-minute increments from the time the last bid is placed until there are no more bids, and the lot sits idle for 2 minutes.
Davies Auction Service has put forth every effort to make accurate descriptions of the items. Printed or verbal statements made by staff are matters of opinion and are made in good faith. However, all items are sold AS IS, WHERE IS. You are responsible for your own inspection during inspection periods.
All sales are final. A bid is a legal binding contract between you and Davies Auction Service LLC.
Davies Auction Service reserves the right to reject any and all bids for any reason. No allowance will be made for errors in cataloging, genuineness, defects, or imperfections not noted. If a refund is given, it will not exceed the purchase price of the lot.
Bidder responsibilities include but are not limited to: Bidders agree to keep their password confidential as they are responsible for ANY and ALL activity involving their account. When using the website, you must obey any and all local, state, and federal laws. Violations will result in termination of website use privileges.
Auction company employees and/or the auction company may bid on auction items.
Payment Information:
Payments accepted during scheduled pick up include cash, certified check, cashier’s check, or credit/debit card. A 3.5% fee will be assessed to all credit/debit card sales. Wire transfers must be made a minimum of 24 hours before pick-up.
NO PERSONAL OR BUSINESS CHECKS unless accompanied by a letter of guarantee from the bank which must be dated & signed. PLEASE DO NOT MAIL ANY PAYMENTS.
BUYER'S PREMIUM
A buyer's premium of 10% of the high bid will be added to the high bid to determine the final sales price for the auction lot.
Example: $100 bid + $10.00 buyer's premium = $110.00 invoice amount
HAULING INFORMATION:
Please bring help to load and arrange your own hauling.
Items need to be picked up during the scheduled pick-up time. Items not picked up due to customers not showing up to pick up or did not have any prior communication with Davies Auction Service will incur a MINIMUM $30.00 late fee.
Shipping Information:
Please email the auction company to check the availability for shipping before bidding as it is not always available. If you would like your item(s) shipped, the shipping fee and a handling fee will be applied to your invoice. Shipping is standard shipping rates plus handling (typically $20 or more).
Titled Vehicle Purchases:
All titles will be certified mailed within 5 business days of actual vehicle pick up.
Titled Vehicles will be held on premises until funds are guaranteed cleared by the bank. This includes bank checks. This can take up to 2 weeks, if that does not work for you then please DO NOT BID!
Inspection: Due to safety and liability reasons, there will be no in-person inspection for hunting knives, ammunition and firearms. All firearms have been graded by Arnold Erhardt, former gun smith for over 40 years at Capital Sports. When you view each firearm lot, the condition listed is per Arnold.
Firearms: The firearms in this auction are lots 10 through 26. These firearms will be taken to Capital Sports in Helena, Montana and ran through their FFL before the buyers take possession. The buyers will show their ID, fill out form 4473, and undergo a successful FBI background check before being allowed possession of the firearm. If the buyer is not qualified to possess the firearm, the auction company will assess a 20% restocking fee based on their bid. In addition, the buyer’s premium will not be refunded. Please do not bid if you know you will not pass the background check. Also, it is the responsibility of each bidder to verify if the firearm they are interested in acquiring is legal in their local area. Please be patient and allow a minimum of 1 week and perhaps more for the firearms to be processed and ready to either be picked up or shipped.
Age: Nobody under 21 is allowed to bid on the firearms and ammunition.
Montana Resident Firearm Buyers: Nobody except the registered bidder will be allowed to pick up the firearm from Capital Sports.
Montana Bordering State Firearm Buyers: Idaho, Wyoming, North Dakota and South Dakota: The buyer can physically pickup the rifles and shotguns from Capital Sports once all the requirements above have been met. All handguns must be shipped to an FFL in your state unless you live in Montana.
Out of State Firearm Buyers: (All other states not bordering Montana): Commensurate with Federal Law, firearms will only be shipped to a holder of an FFL. If you do not have an FFL yourself, your firearm(s) will need to be sent to an FFL Holder in your state to finish the transfer. It is your responsibility to contact an FFL in your area prior to bidding to ensure you qualify. There are NO firearm sales to California Residents.
Payment for Firearms: All firearms must be paid for in full within 48 hours of close of auction. Firearm payments must be either via cash or credit/debit card. There will be an additional $50 per firearm assessed to your final bid to cover the FFL transfer in Montana. If you purchase more than 1 firearm, each additional firearm will only be assessed a $10 fee for FFL transfer. If your firearm(s) needs to be shipped, we will also assess your credit card the shipping cost. In addition, if you are not an FFL, you will be responsible to pay your local FFL transfer fee on your end in order to receive the firearm.
Ammunition, Primers & Powder: We will not ship ammunition, primers and powder. They must be picked up. No one under 21 is allowed to bid on these items.
The Browning Gun Safe: The safe will not be immediately available for pickup, please anticipate a minimum of 2 to 3 weeks after the auction closes. Once the safe is available, you will be notified.
Warranty & Condition of Items Sold: All items are sold as-is, where is, with no warranty expressed or implied. You are responsible to determine the condition of the items and bid accordingly. You are bidding on the item listed and described, occasionally a photo captures other items that are not in the lot. You are responsible to read the lot description.
Software Issues: In case of software issues or any other online technical difficulties, the auction company reserves the right to extend or close the bidding.
The auction company will not be held responsible for any missed bids or software failing to function properly.
